Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of Treform (the "Service"), including the web application at app.treform.ai and the marketing site at treform.ai (together, the "Platform"). The Service is operated by Treclipse Inc. ("Treclipse," "we," "us," or "our"). "Treform" is a product of Treclipse Inc.
By creating an account, signing in, or otherwise accessing or using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.
2. Attribution and Open-Source Components
Treform is built on top of the open-source Pascal Editor project, released under the MIT License. Portions of the Service incorporate Pascal Editor source code, derivative works, and contributions from the Pascal Editor community. We gratefully acknowledge the Pascal Editor project and its contributors.
The MIT License applies only to the portions of the Service derived from Pascal Editor and does not apply to proprietary Treclipse code, the hosted Platform, our branding, our trademarks, third-party services integrated into the Platform, or any AI-generated output made available through the Service. Copies of the applicable open-source licenses and third-party notices are available on request at support@treclipse.ai.
3. Accounts and Eligibility
You must be at least 13 years old to use the Service (or the minimum age required by law in your jurisdiction, whichever is higher). Certain features may require you to be the age of majority in your jurisdiction.
We use Google OAuth and magic-link email authentication through Supabase. You are responsible for maintaining the confidentiality of your account credentials, for all activity that occurs under your account, and for promptly notifying us of any unauthorized access. You may not share your account or transfer it to another person.
4. Plans, Billing, and Renewals
The Service offers a free plan and paid subscription plans (including, at our discretion, Pro, Studio, and Bring-Your-Own-Key ("BYOK") tiers). Features, usage quotas (for AI edits and renders), and pricing for each plan are described on the pricing page and may change at any time.
Payment processor. Paid subscriptions are processed through Whop, our third-party payment partner. By subscribing, you also agree to Whop's terms and authorize Whop to charge your chosen payment method on a recurring basis (monthly or annual, as selected) until you cancel.
Quotas and metering. Paid plans include a per-cycle allotment of AI edits and renders. Usage is metered atomically and resets each billing cycle. Unused quota does not roll over. When your quota is exhausted you must either wait for the next reset, upgrade, or (if on BYOK) continue using your own API credits.
BYOK. On the BYOK plan you supply your own Anthropic API key, which we store encrypted. You are solely responsible for charges incurred on your provider account. We do not reimburse for BYOK provider charges, including charges resulting from bugs, retries, prompt injection, or abuse of your account.
Taxes. Prices exclude taxes unless stated otherwise. You are responsible for all applicable taxes, duties, and levies associated with your subscription, excluding taxes based on our net income.
Cancellation and refunds. You can cancel at any time through the Manage Account menu or via Whop. Cancellation takes effect at the end of the current billing period; you retain access until then. Except where required by law, fees already paid are non-refundable and partial-period refunds are not provided. If you believe you were billed in error, contact support@treclipse.ai within 14 days of the charge.
Price changes. We may change subscription prices by providing at least 30 days' notice by email or in-app notice. Price changes take effect at your next renewal; if you do not agree, you may cancel before the renewal.
5. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated by reference. Without limiting that policy, you agree not to:
- Use the Service to violate any law or third-party rights;
- Upload, generate, or distribute content that is unlawful, infringing, defamatory, harassing, harmful to minors, or that depicts real people in non-consensual or misleading ways;
- Attempt to reverse-engineer the Service, circumvent usage quotas, probe or disrupt our infrastructure, or introduce malware;
- Use the Service or its AI features to build a competing product, train a third-party model, or scrape model outputs in bulk;
- Use the Service to provide professional architectural, engineering, zoning, code compliance, or life-safety advice to third parties without independent licensed review.
6. Your Content and Intellectual Property
Your Content. "Your Content" means projects, designs, scene data, prompts, uploaded images, and other materials you submit to the Service. As between you and Treclipse, you retain all rights in Your Content.
License to us. You grant Treclipse a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, display, and create derivative works of Your Content solely to operate, secure, and improve the Service for you, to provide support, and to comply with law. This license ends when you delete Your Content or your account, except for backups retained for a reasonable time and copies we are required to retain by law.
Use for model training. We do not use Your Content to train our own generative models. We do not authorize our AI subprocessors (such as Anthropic or FAL) to train their foundation models on Your Content, consistent with their API terms. See our Subprocessors page for details.
Outputs. Subject to these Terms and third-party model terms, you own the outputs the AI features generate in response to your prompts, to the extent such outputs are eligible for ownership under applicable law. You are solely responsible for reviewing outputs before relying on them, and for ensuring your prompts and uploaded materials do not infringe any rights.
Feedback. If you send us feedback, suggestions, or bug reports, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose, without obligation or attribution.
Our IP. The Service, excluding Your Content and open-source components licensed separately, is owned by Treclipse Inc. and protected by intellectual property laws. "Treform," "Treclipse," and our logos are trademarks of Treclipse Inc. You may not use them without our prior written permission.
7. AI Features and Disclaimers
The Service uses third-party large language models and generative image models (including models operated by Anthropic and FAL) to produce text, scene modifications, and rendered imagery ("AI Outputs"). AI Outputs are probabilistic and may be inaccurate, incomplete, biased, or offensive, may reflect the same input back to different users, and may not be suitable for your intended use.
AI Outputs are not a substitute for professional architectural, engineering, surveying, planning, code compliance, accessibility, structural, or life-safety advice. You are solely responsible for reviewing, verifying, and (where appropriate) obtaining licensed professional review of any design or output before relying on it for construction, permitting, or any safety-sensitive purpose.
8. Third-Party Services
The Service integrates with third-party services, including Supabase (auth and database), Vercel (hosting), Whop (payments), Anthropic (AI), FAL (image generation), Brevo (transactional email), and Google (OAuth). Your use of those services through the Platform is subject to their terms and privacy notices. We are not responsible for the availability, accuracy, or practices of third-party services. 9. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or applicable law, or if required for security, legal, or operational reasons. Where practical we will give notice and an opportunity to cure.
You may terminate by canceling your subscription and deleting your account through the Manage Account menu, or by emailing support@treclipse.ai. Upon termination, your right to use the Service ends. Sections intended to survive termination (including IP, disclaimers, liability, indemnification, and governing law) will survive.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR PURPOSES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRECLIPSE INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Indemnification
You will indemnify, defend, and hold harmless Treclipse Inc. and its affiliates, officers, employees, and suppliers from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the Service, including AI Outputs you act on, (c) your violation of these Terms or the Acceptable Use Policy, or (d) your violation of any law or third-party right.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to mandatory arbitration or that is otherwise not resolvable informally, subject to any mandatory consumer-protection rights you have under the law of your residence.
You agree to first attempt to resolve any dispute informally by contacting support@treclipse.ai before filing any formal claim.
14. Changes to the Service or Terms
We may update the Service or these Terms from time to time. For material changes to these Terms, we will provide reasonable advance notice (by email or in-app notice). Changes take effect on the effective date stated in the updated Terms. Continued use of the Service after that date constitutes acceptance of the revised Terms.
15. Miscellaneous
These Terms, together with the Privacy Policy and Acceptable Use Policy, form the entire agreement between you and Treclipse about the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
